Lesson 2: Keeping Confidence
When you keep a client’s information in confidence, you understand what you can share with other clients and what you must keep secret. The following information is considered confidential:
- That the seller or lessor is willing to settle for an amount less than what was made in an offer or decided on in the brokerage agreement,
- That the buyer or lessee is willing to agree to pay a larger amount than the one offered,
- The factors/facts motivating the buyer, seller, lessee, or lessor to make a deal, including urgency and financial situation.
- The negotiating strategy employed by a client, or by you on behalf of a client.
Permission to Disclose Confidential Information
Confidential client information may be shared only upon the receiving of a written permission from the client in question. Without this written permission, must be careful not to share such information about your client(s) with:
• Other clients with whom you’re working
• Clients working with your broker
• Other real estate agents
• Representatives of other parties
Note that there is an exception for this, licensee is required to share confidential information if it was asked by a court of law.
